Property at 1167 Tolman has now been surveyed as County Surveyor File 19462. Michael Jacobson and the City of Ashland have successfully created another tax lot…..
This could not have been accomplished without the additional square footage taken from the northside property – Me!
Michael Jacobson did not meet the zoning requirements of 7,500 ft. (R 1.75).

To make matters worse, a 10′ wide storm drain easement was created on north side property line for the benefit of Lot 1.
The sidewalk to my studio is now a storm drain easement.

The Jacobsons request for a land partition was approved with conditions.
I’m stunned…..
I still feel confident the Jacobsons will do the right thing and an equitable solution would be found.
I’m going to fight this – with research!

In 1994, Jackson County files a quit claim deed on Evelyn’s behalf.
It is now a taxable lot.
But where did it come from?

It had belonged to Jackson County and was not tax assessable.

I begin researching records. I get the run around. Information was not readily available nor offered. I got caught up in lot 1900. This little sliver of land is almost an exact replica of the piece of land taken away from me.

At some point a public hearing notice is posted in the SE Corner of the property, the opposite corner of the disputed property to the north and far from the newly created tax lot to the west. I never saw the posting. It was not clearly visible.
When I went down to City Planning to inquire as to what was going on, I was told that in order to address my issues I needed to submit a written request for a public hearing and I had already missed the deadline for such action. And I thought hearings were mandatory.
I was wrong.
Some planning actions require a public hearing and all others are upon request.
I’m lost.
I do not understand any of this and Derek Severson (City Planning) advises me to seek out an attorney for advice. It’s a civil matter.

2005 – While I’m playing the ‘sit and wait’ game, Michael Jacobson initiates PA 2005-01953 to partition his lots into two parcels.
The Jacobsons were no longer communicating with me. I was completely left out of the planning process.
And still no survey!

Michael Jacobson took a firm stand that he was not going to let this minor inconvenience interfere with his plans.
My initial reaction was to quickly find a solution and compromise.
I suggested he grant me an easement off Black Oak and I would compensate by granting him additional SQ ft. of my property. This would give him the necessary 7,500 sq ft. to create the lot that he is envisioning.
No!
Then I suggested giving him the SQ footage needed to create parcel 3 if parcel one and two remained “as is”.
No!
I then called Derek Severson (Planning Dept., City of Ashland). Our meeting consisted of photo sharing and my disclosure of the property line dispute and my inability to resolve the issue. I showed him my resolution to flag off Black Oak. He agreed to a site visit.
It was on this visit that he told me the Jacobsons have once again reconsidered their options and are now planning two parcels instead of three and that no survey has been done yet.
Therefore, until survey was complete, I had no argument. Once survey was submitted and if allegations were true, then I would need to research Jackson County Records for answers.
